Township
receives a public scolding for
"Wrongful Acts" lawsuitsAt
the July 21st Board meeting Bob
Gandolfi of Municipal Underwriters
Insurance Company scolded the
Kinross Township Board for
Wrongful Acts
lawsuits. "Your track record is not
good for the past two years" said
Bob. One of the reasons for the bad
track record is possibly that
"Things are not being handled
properly." Wrongful Acts
lawsuits are very rare and for you
to have two in a 24 month period is
quite unusual and this has got
everybody's attention."
The question now is will this get
the attention of the voters? The
irresponsible actions of Clerk
Besteman, and Treasurer Ulrich need
to be addressed by the people in the
coming elections.
Wrongful
Acts lawsuits are defined as
Error, misstatement, or breach of
duty by an officer or director of a
company that results in a lawsuit
against the company. Directors and
Officers Liability Insurance covers
claims arising from wrongful acts by
directors or officers of a company
while in that capacity.
Municipal Underwriters plan to have
risk management training for the new
Board once the elections are over.
Additionally, the township will be
required to cover a $5,000
deductible for any claims under its
“public officials-wrongful acts”
coverage.
